أصدر البنك المركزي السعودي «ساما» أخيراً، اللائحة التنفيذية لنظام مراقبة شركات التمويل.
وتضمنت اللائحة أن للمستفيد الحق في تعجيل سداد باقي مبلغ التمويل في أي وقت.
ونصت اللائحة على أنه لا يجوز لشركة التمويل تحميل المستفيد كلفة الأجل عن المدة المتبقية في العقد، ولكن يجوز لشركة التمويل الحصول على تعويض كالتالي: كلفة إعادة الاستثمار بما لا يتجاوز كلفة الأجل للأشهر الثلاثة التالية للسداد محسوبة على أساس الرصيد المتناقص، وما تدفعه شركة التمويل لطرف ثالث بسبب عقد التمويل من النفقات التي نص عليها العقد، وإذا كانت نفقات لا يمكن استردادها وذلك عن المدة المتبقية من عقد التمويل.
استثناء عقود التمويل العقاري
ووفقاً للائحة فإنه تم استثناء عقود التمويل العقاري، حيث يجوز أن ينص عقد التمويل العقاري على فترة يحظر فيها السداد المبكر بشرط ألا تتجاوز مدة الحظر سنتين من تاريخ إبرام عقد التمويل العقاري.
The Saudi Central Bank “SAMA” has recently issued the executive regulations for the Financing Companies Control System.
The regulations stipulate that the beneficiary has the right to expedite the repayment of the remaining amount of financing at any time.
The regulations state that the financing company may not charge the beneficiary the cost of the term for the remaining period of the contract, but the financing company may receive compensation as follows: the cost of reinvestment not exceeding the cost of the term for the three months following the repayment calculated on the basis of the declining balance, and what the financing company pays to a third party due to the financing contract from the expenses specified in the contract, and if there are non-recoverable expenses for the remaining period of the financing contract.
Exemption of Real Estate Financing Contracts
According to the regulations, real estate financing contracts are exempted, as the real estate financing contract may stipulate a period during which early repayment is prohibited, provided that the prohibition period does not exceed two years from the date of signing the real estate financing contract.
